Step 1
Determine the settlement period during which the non-fulfillment of the terms of the contract was committed. Let's say on April 15 the buyer had to pay for the goods shipped to him in the amount of 56 thousand rubles. After two months, the invoice was still not paid. Thus, to determine the billing period, a month is taken, or rather, 60 days of delay.
Step 2
Check the refinancing rate as of the date of interest calculation. According to the latest data from the Central Bank of Russia (Central Bank Ordinance dated April 29, 2011 No. 2618U "On the size of the refinancing rate"), the refinancing rate in 2011 is 8.25%.
Step 3
Calculate the amount of interest under the contract using the following formula:
Interest amount = (Debt * Number of days of delay * Refinancing rate) / 360 According to the above example, the Interest amount together with the debt will be:
(56,000 * 60 * 8.25%) / 360 = 77,000 rubles. In other words, for two months of delay, the buyer will have to pay interest in the amount of 21,000 rubles. not taken into account for calculation. For example, Ivanov A. A. rents a bus from a leasing company. Every month on the first day, he must pay 15 thousand rubles under a lease agreement. Let's say the payment was not made on April 1. The leasing company, after waiting until the 15th day of the next month and not receiving a monthly fee, charges interest for non-fulfillment of the terms of the contract. But the contract stipulates that for each month of delay, Ivanov A. A. will be obliged to pay 2% of the amount owed. Then interest on the outstanding lease is calculated as follows:
(15000 * 0.5 * 2%) / 360 = 41 p.
