According to article 81 of the Family Code of the Russian Federation, alimony is collected in court in the absence of a voluntary agreement between the spouses. For one child, a quarter of all income of the defendant is calculated, for two children - a third, for three or more children - 50% of all income. Alimony can be increased or decreased for various reasons, but invariably only by a court order, if there is no voluntary agreement.

Instructions

Step 1

If you have several children, then they have the right to equal maintenance. Therefore, you will pay the amount of alimony that will be awarded to you. According to the Civil Code, a debtor is not entitled to deduct more than 75% of the amount of income, but this amount can only be deducted if there is a debt on alimony or other debt obligations. In all other cases, no matter how many minors you have, to whom you are obliged to pay alimony as monetary support, 50% will be deducted from your income and this amount will be divided among all children as a percentage.

Step 2

If you have one child, then you will be awarded to pay him 25% of your income, if you have two children, then you will pay 33%, for three or more children you are required to pay half of all your income. For example, if you have two children from different marriages, then each child will receive 16.5% of your income. If you have three children from different marriages, you are obliged to pay each of them 16.6%.

Step 3

If you have a non-systematic income or do not work, then you will be awarded to pay alimony in a fixed amount, and for each child you will transfer an amount not lower than the amount calculated with the minimum wage in percentage terms according to the law. From June 1, 2011, the minimum wage is 4611 rubles. Based on this, the amount of alimony per child cannot be less than 1152 rubles 75 kopecks. For two children - 1521 rubles 63 kopecks, for three and more - 2305.55.

Step 4

If you stopped paying alimony to one of the children due to the onset of majority or legal capacity, then all other children will be able to count on a large amount of financial support. This is especially true if alimony is distributed based on the amount of income for several children, the number of which exceeds three.
