In the event of an insured event, it is necessary to contact the company with which the corresponding agreement has been concluded, with an application for insurance payment. However, it happens that many insurers pay compensation that is much less than expected. To resolve this issue, you must dispute the payment in accordance with the established procedure.
Instructions
Step 1
Review a copy of the insurance claims expert report that the insurance company has provided. Check the points you disagree with and try to challenge them directly with the firm's manager. If your attempts to increase your payout are unsuccessful, you need to start a challenge procedure.
Step 2
Conduct an independent examination to assess the damage received. To do this, contact an appraisal company that specializes in insurance claims. Determine the date, time and place of the examination and provide this information to your insurance company. Its representatives must be present during the assessment without fail. The expert has the right to start the operation if one of the parties does not appear within an hour at the indicated place.
Step 3
Write a pre-trial claim addressed to the head of the insurance company. In parallel, you can send a complaint to Insurance Supervision. Indicate your requirements, referring to the articles of the law, clauses of the insurance contract and the independent assessment of the damage received.
Step 4
Use mail services to send a certified letter. Save all receipts and mailing stubs that will help you if you go to court. The insurance company must give you a written answer within ten business days.
Step 5
Go to court with a statement of claim if you were unable to dispute the insurance payment amicably. Attach all documents related to the case to the claim: insurance contract, expert opinions, receipts and checks.
Step 6
Hire an experienced lawyer to help you prove your case and get the money you need. You also have the right to receive moral and material compensation, as well as to establish the amount of penalties for late payment of the legal amount in an insured event.
