If you become a participant in an accident and due to the fault of another driver, you have suffered property damage, then you are entitled to a payment for OSAGO, which must be made by the insurance company of the guilty car owner. The law stipulates that if both vehicles are insured under compulsory auto insurance and there are no citizens whose health or life has been harmed, then insurance can be obtained in a simplified way by drawing up a notification of an accident together with another participant without calling the traffic police. However, at the same time, the maximum possible amount of insurance payment that the insurance company will pay is no more than 25,000 rubles, and if the amount of damage is higher than this amount, you will have to make claims to the most guilty car owner.

Therefore, after an accident, first try to roughly determine the amount of damage: if the estimated amount of damage in your opinion exceeds 25,000 rubles, then call a traffic police officer to the scene of the accident, who will draw up a protocol and give you a certificate of participation in the accident. In this case, insurance in case of an accident will be paid to you in the amount of real damage within 120,000 rubles.

Then contact the insurance company that insured the liability of the perpetrator of the accident, or your insurance company (in the event that an appropriate indemnification agreement has been concluded between them) with a claim for the payment of the sum insured and submit the damaged car for inspection and assessment of the amount of damage. After that, the insurance company will draw up an act on the insured event and make you an insurance payment under the OSAGO.
Step 4
If you do not agree with the amount of insurance paid, then contact the organization that carries out the assessment for an independent examination. Next, go to court with a claim to recover from the insurance company the difference between the damage caused and the insurance paid.
Step 5
Attach to the application to the court a protocol and a certificate of an accident drawn up by a traffic police officer, an independent expert opinion on the cost of refurbishment and a receipt for payment of the cost of an independent assessment and payment of state duty.
