If the borrower does not fulfill its obligations to repay the loan, the bank can transfer the rights to collect the debt to a collection agency. Such organizations have long been widely used in Western countries, but their activities in the Russian market of credit services have not yet undergone final legal regulation. The work of the collectors is based on civil law.

Step 1

Legal collection agencies operate in Russia on the basis of the Civil Code, carrying out their activities within the framework of the law. And yet, conflict situations often take place between borrowers and collection organizations associated with a lack of understanding of the specifics of debt recovery activities.

Step 2

At the first stage of the work of the collectors, they receive information about the defaulter from the bank in which the loan was made. On the basis of an agency agreement, the collectors start working with the debtor using the methods of influence permitted by law.

Step 3

Agency representatives in all possible ways establish contact with the borrower. This can be a phone call, an email, or a short message from a mobile phone. After establishing contact, preliminary negotiations are held.

Step 4

The task of the collectors is to find a common language with the debtor and find out the real reasons that do not allow him to pay off the debt. At the same time, the agency's employees initially proceed from the fact that the borrower is not a fraud, but simply got into a hopeless financial situation. At this stage of work, the ability to communicate and conduct competent negotiations is important for the collector.

Step 5

If the negotiations go well, the collection agency offers the borrower to restructure the debt by breaking it down for a longer period. In many cases, the solution is to defer payments on the principal amount with mandatory payment of interest on the loan.

Step 6

When it is not possible to establish effective contact with the debtor by phone, the agency representatives visit his home or place of work. The conversation becomes harsher and more uncompromising. Collectors explain to the debtor the legal consequences of refusal to fulfill obligations and offer reasonable solutions to the situation.

Step 7

It happens that even such an impact does not lead to the desired result. Then comes the stage of judicial enforcement. The issue of repayment of the loan on the proposal of the collection agency is decided in court. In accordance with the procedure established by law, the court makes a decision, after which enforcement proceedings are opened to arrest the debtor's property. Now the process of debt recovery is controlled by the bailiff service.
